These Terms of Service ("Terms") govern all digital services provided by NishantWorks, an independent freelance digital services consultancy operated by Nishant, based in Greater Noida, Uttar Pradesh, India. By engaging our services or submitting an enquiry, you agree to these Terms.
NishantWorks provides freelance digital services including website design and development, search engine optimisation (SEO), digital marketing, and mobile application development. All services are delivered on a project or retainer basis as mutually agreed upon in writing (email or WhatsApp confirmation is accepted).
Each project begins with a scope of work agreed upon by both parties. Any changes to scope ("change requests") must be agreed in writing and may result in additional charges. We reserve the right to decline requests that fall outside the original agreed scope.
A minimum advance payment (typically 50% for projects under ₹25,000 and 40% for larger projects) is required before work commences. The balance is due upon project completion and before final delivery of files or live deployment. For monthly retainer services, payment is due at the start of each billing cycle. Late payments may result in work suspension.
While we apply proven SEO techniques and have a strong track record, search engine rankings are determined by third-party algorithms (Google, Bing, etc.) that are outside our control. We do not guarantee specific ranking positions or timelines. Our commitment is to apply industry-best practices diligently and transparently report on progress.
Upon receipt of full payment, all custom work product (designs, code, content) created for your project becomes your property. Until full payment is received, all work remains the intellectual property of NishantWorks. We reserve the right to display completed work in our portfolio unless you request confidentiality in writing.
You agree to provide timely access to required materials (logins, content, branding assets), provide feedback within agreed timelines, and ensure all content you supply is lawfully owned or licensed. Delays caused by late client feedback may affect delivery timelines without penalty to NishantWorks.
If you cancel a project after work has commenced, advance payments are non-refundable for work already delivered. For retainer services, cancellation requires 15 days' written notice. Refund eligibility for partially completed work is assessed case-by-case at our discretion.
NishantWorks shall not be liable for any indirect, incidental, or consequential loss (including loss of revenue or data) arising from use of our services or website. Our total liability in any matter shall not exceed the total fees paid by you for the specific service in question.
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Gautam Buddh Nagar (Greater Noida), Uttar Pradesh.
We reserve the right to update these Terms at any time. Changes are effective upon posting to this page. Continued use of our services after changes constitutes acceptance of the revised Terms.
